Plaintiffs' causes of action arose from an agreement settling litigation between the brand-name manufacturer and one of the generic manufacturers concerning the validity of the brand-named manufacturer's patent and related agreements involving the other defendants. The court concluded that the agreements did not violate the Cartwright Act because the agreements undisputedly did not restrain competition beyond the exclusionary scope of the patent. P. 23(a)(2), (b)(3) commonality, the court rejected defendant's contention that plaintiffs' claims would require independent proof on the questions of willful failure to pay and unconstitutionally disproportionate damages under Cal. Defendants moved to dismiss the master complaint.\n\n\n\nOverview\nA <a href=\"https://california-business-lawyer-corporate-lawyer.com/civil-litigation-attorney-and-trial-attorney/\">civil trial lawyer</a> specializes in defending clients before a court of law and in giving legal advice, conducting lawsuits, etc. The carrier argued that the claims challenged its 3G rates and market entrance, and such claims were preempted by the Federal Communications Act of 1934 (FCA), 47 U.S.C.S. § 151 et seq. The court agreed that the claims were preempted as to the carrier where the core allegations that defendants knew that the network was not sufficiently developed to accommodate the number of phone users and that defendants deceived the customers into paying higher rates for a service that defendants knew they could not deliver implicated the reasonableness of the carrier's rates. In essence, the customers were paying for the 3G service, for which the carrier charged a higher rate, but received 2G service. Since the customer's claims were an attack on the carrier's rates and 3G market entry, they were preempted by the FCA. The Federal Communications Commission's opinions and district court decisions dealing with the scope of FCA preemption of state law remedies were in accord. Since the claims against the manufacturer were inextricably tied to the claims against the carrier and the carrier was an indispensable party, the claims were also dismissed as to the manufacturer.\n\n\n\nOutcome\nThe motion to dismiss the master complaint was granted. All other motions were denied.\n\nProcedural Posture\nPlaintiff employee appealed an order of the Superior Court of Orange County, California, which granted defendant employer's motion to strike class allegations from her complaint that alleged causes of action for failure to pay overtime compensation under Lab. Code, §§ 1194, 1197, and disgorgement of unpaid wages under Bus. & Prof. Code, § 17200 et seq.\n\n\n\nOverview\nTwo years before the employee filed her complaint, two other persons filed a class action complaint against the employer on behalf of all managers and assistant managers in its California stores during the preceding four years, alleging the same causes of action. The three plaintiffs subsequently filed a coordinated complaint against the employer. The court held the trial court correctly handled the motion under class certification guidelines, properly receiving evidence on the class certification issue and exercising its discretion in denying certification. The motion filed under Cal. Rules of Court, rule 3.767, was not an attack on the pleadings, like a traditional motion to strike; rather, it was a request to initiate the class certification process. The motion was timely, and the trial court properly took evidence outside the pleadings and denied the belated discovery request. Plaintiffs received proper notice of the employer's motion and had the opportunity to respond with evidence of their own. They presented nothing to counter the employer's evidence that the action did not meet the requirements of a class action. Because defendant showed that it would be unduly burdensome to fully respond to Category 3 document requests, the court accepted defendant's proposal to provide \"sample\" discovery.\n\n\n\nOutcome\nThe court granted plaintiff's motion to compel the documents in Categories 1 and 2. The court granted in part the motion to compel documents in Category 3 and ordered defendant to provide documents from eight California stores selected by plaintiff. Bus. & Prof. Code § 17200. The manufacturer renewed its motion for summary judgment.\n\n\n\nOverview\nThe manufacturer introduced ritonavir as a stand-alone PI with a daily recommended dose that cost approximately 18 dollars per day. After its release, it was discovered that, when used in small quantities with other PIs, ritonavir would \"boost\" the anti-viral properties of that other PI. But its use as a booster, and not a stand-alone PI, also meant that the average daily price plummeted because patients needed only a small daily dose. The court held that plaintiffs had shown injury to competition and actual exercise of market power, thus creating a material factual dispute. The court could not determine the manufacturer's correct market share percentage; that had to be determined by a jury. The hundreds of millions of dollars required, combined with the patents already in the field and the years required to get a product to the market, created a material factual dispute whether there are significant barriers to entry into the boosted market. There was evidence that the manufacturer abused its patent rights to ritonavir to maintain its monopoly in the boosted market. The court was persuaded that the manufacturer had disclaimed the use of ritonavir with other PIs to treat HIV.\n\n\n\nOutcome\nThe manufacturer's renewed motion for summary judgment motion was denied.",

Petitioner sought a writ of mandate to direct the superior court to vacate its disqualification order die to violation of <a href=\"https://california-business-lawyer-corporate-lawyer.com/california-labor-law-attorney-for-employers/minimum-wage-san-diego/\">california minimum wage san diego</a>.\r</p>\n<p>\r</p>\n<p>\r</p>\n<p>\r</p>\n<p>Petitioner&#x27;s insurer hired a law firm to defend him. Subsequently, the insurer decided to appoint an independent counsel to represent petitioner. The insurer kept the law firm it had originally hired for petitioner to represent its own interests. One of the insurer&#x27;s law firm&#x27;s attorneys agreed to represent the independent counsel at some depositions. However, the attorney discovered, before suit was filed, that the real parties in interest had contacted one of the partners of the insurer&#x27;s law firm about possible representation. Ultimately, the real parties did not retain the insurer&#x27;s law firm. Nonetheless, after the insurer&#x27;s law firm realized what happened, it withdrew from representation of the insurer. The real parties then moved to disqualify the independent counsel, asserting there was a presumption that the law firm divulged confidential information to the independent counsel. The appellate court declined to extend the doctrine of imputed knowledge to automatically disqualify the independent counsel, when the insurer&#x27;s attorney merely covered a few depositions for the independent counsel, and, unbeknownst to him, his firm had a conflict of interest.\r</p>\n<p>\r</p>\n<p>\r</p>\n<p>\r</p>\n<p>The writ issued directing the superior court to vacate its order disqualifying the independent counsel and to enter a new and different order denying real parties&#x27; motion for disqualification.\r</p>\n<p>\r</p>\n<p>Real party in interest employee brought suit, as an individual and as a putative class representative, alleging petitioner store violated wage orders for non-exempt employees and committed unlawful business practices. The store demurred to the complaint. Respondent superior court overruled the demurrer. The store sought a writ of mandate.\r</p>\n<p>\r</p>\n<p>\r</p>\n<p>\r</p>\n<p>The employee, a former manager, alleged that the store was wrongfully deducting expenses from the wages of its employees, which the law required to be borne by employers. The appellate court determined that the employee had stated a cause of action for violation of Cal. Lab. Code § 3751. As to non-exempt employees, alleged deductions based on cash and merchandise shortages was sufficient to withstand demurrer, despite the store&#x27;s argument that a profit-based plan was beneficial for all employees. The appellate court disagreed with the store that its employees were not suffering a reduction in earnings. On the other hand, for exempt employees, to whom the wage order, Cal. Code Regs. tit. 8., § 110701(A), did not apply, the result was different. Nothing in the Labor Code itself, unlike the wage orders applicable to non-exempt employees, expressly prohibited deductions from wages for cash or merchandise shortages. Based on those convictions, the court had had suspended the attorney from the practice of law and referred the matter to the state bar for a hearing, report, and recommendation as to the discipline to be imposed. The board submitted a recommendation that he be placed on probation for three years on the condition that he be suspended from practice for the first two years. The attorney argued that the board omitted findings by a local administrative committee that the attorney was completely rehabilitated and that the recommendation was too harsh. The court found the board actually set forth the evidence that was favorable to the attorney, and consideration of that evidence would be relevant to the discipline imposed. The court further found that the board initially recommended disbarment, but, on rehearing, reduced the penalty. Moreover, the crime that the attorney committed normally warranted disbarment in the absence of extenuating circumstances. The attorney failed to show the board&#x27;s recommendation lacked support or was not just, so the court adopted the recommendation.\r</p>\n<p>\r</p>\n<p>\r</p>\n<p>\r</p>\n<p>The court ordered that the attorney was to be suspended from the practice of law for three years and that he be placed on probation for three years on the conditions prescribed in the board&#x27;s recommendations.\r</p>\n<p>\r</p>\n<p>Petitioner contractor sought a writ of mandate directing respondent Contractors&#x27; State License Board (board) to set aside its order and decision revoking the contractor&#x27;s license, to restore the license, and to dismiss a complaint and proceedings pending before the board. The customers were also led to believe that the prices that they were paying for the siding were substantially less than prevailing prices. A hearing officer found the contractor in violation of the business and professional code. The contractor argued that the hearing officer was biased. On appeal, the court affirmed the trial court&#x27;s judgment upholding the board&#x27;s decision to revoke the license. The court held that even if the hearing officer was brusque, that did not entitle the contractor to the writ because there was substantial evidence to support the complaint. The court found that the contractor charged more for the siding than other contractors even though it claimed that its prices were lower, and it allowed its salesmen, who were not licensed, to receive money from the deals.\r</p>\n<p>\r</p>\n<p>\r</p>\n<p>\r</p>\n<p>The court affirmed the judgment of the trial court, which denied the writ of mandate requested by the contractor to have its license reinstated.\r</p>\n<p></p>\n</html>",

Defendant had agreed to erect a chimney and fireplace for the sum of $ 100 if the client would furnish the materials and would help on the job. The court held that defendant&#x27;s appointed counsel&#x27;s withdrawal of a plea of not guilty by reason of insanity, which was entered for him by the trial court, constituted reversible error. The court determined that the trial court should not have allowed the plea to be withdrawn because defendant objected to it and, thus, had not authorized his counsel to do so. The court found that defendant was denied an opportunity to attempt to establish one of his pleaded defenses; thus, he did not receive a fair trial. No error was demonstrated in the fact that defendant&#x27;s admitted prior was known to the judge who heard the evidence relating to the current offense and decided that issue. The evidence was sufficient to sustain the conviction. The failure to charge the codefendant with any offense other than conspiracy could not be deemed an acquittal of the substantive offense. To sentence defendant for conspiracy to commit petty theft in violation of Cal. Penal Code § 182 and for the aggravated petty theft in violation of Cal. Penal Code § 667 when the conspiracy had no objective apart from that crime violated the prohibition in Cal. Penal Code § 654 against multiple punishment.\r</p>\n<p>\r</p>\n<p>\r</p>\n<p>\r</p>\n<p>The judgment was reversed insofar as it imposed a sentence for conspiracy, and in all other respects it was affirmed.\r</p>\n<p></p>\n</html>",
