| body |  To start, let me disclose that I am not a financial advisor, tax advisor, or an accountant. I am just a regular guy working an 8 to 5 job that also likes to trade cryptocurrencies on the side while staying on the right side of the law. The law, the taxation law to be exact, has been anything but straight-forward in explaining the rules revolving around cryptocurrency transactions. With the regulations lacking and constantly changing, tax payers are often left confused. Over the years I've witnessed many instances of people interpreting current laws and regulations towards their advantage when it comes to situations such as 1031 (like-kind) Exchanges. If you recall, this was once a common argument that exchanging one cryptocurrency for another is a non-taxable event because they fall under the rule of exchanging like assets without generating a taxable event until the sale of said asset. This was eventually clarified by the IRS that this rule only applies to real estate properties. While I am not here to discuss the legality of taxation in the first place, and I am not here to choose sides between bending the interpretation of the laws in favor of the tax payer or the government, I am here to touch on one point I have learned over the past few years: When it comes to paying taxes, don't f*** with the government. It is simple. IRS, and the government as a whole, have the absolute resources and power to make your life miserable. Penalties for breaking some of the laws, purposefully or mistakenly, can be costly - both to your finances and to your freedom. A perfect such example of where you should not bend the law is FBAR. What is FBAR? First of, FBAR doesn't really have anything to do with taxes or the IRS. It stands for "Foreign Bank Account Report". It is a report that is filed with FinCen (The Financial Crimes Enforcement Network bureau of the US Department of the Treasury) form 114 each year by every US person (citizen or resident) who owns or has authority over at least one foreign financial account AND the combined value of these accounts equals or exceeds $10,000 USD. For more specific information on what FBAR is and who must file FinCen form 114 visit https://www.irs.gov/businesses/small-businesses-self-employed/report-of-foreign-bank-and-financial-accounts-fbar So what does this have to do with cryprocurrencies? Well, here is where the financial advisors, crypto traders and enthusiasts disagree. In short, if you happen to trade cryptocurrencies on an exchange that is not US based but is a based on a foreign land, it could be interpreted as a foreign account. An example of this is Binance, which is not a US based exchange (not to confuse with Binance.US which is headquartered in the US and abides under US financial laws and regulations). If you have an account with Binance and have had crypto assets there at any time in the calendar year, you might be required to file the FBAR. But it gets even more confusing. The IRS regulation states that FBAR must be filed if the total value of all assets in foreign accounts exceeds $10,000. That means that even you had less than $10k worth of cryptocurrencies with one foreign exchange, you must consider all foreign exchanges and accounts before determining your requirement to file the FBAR. How to determine the value. This is even harder to figure out. The rule specifies that the total value of all your foreign accounts must exceed $10,000 at any time in a calendar year. This means that you must know the USD value of all the cryptocurrencies for any given calendar day. With the prices fluctuating from minute to minute it is not an easy task. There as some obvious scenarios here - if you bought 1 BTC on a foreign exchange for $6,000 and kept it there until it reached $10,000 in value - you must file the FBAR. I suppose similarly, if you bought 1 BTC for $6,000 and transferred it out of the foreign account to say your private wallet, then later purchased another BTC at say $7,000 and again transferred it to your personal wallet, then the account value would not had exceeded $10,000 USD and you would not need to file the FBAR. In this case the account value would not had exceeded $7,000 USD. Please note again that it is my personal interpretation and not a professional one. So what if I don't file the FBAR? Well, you might get away with it, or you may not. IRS and the government want their portion of your profits, and they are up to all the tricks. Their job is to collect your money. FinCen is not here to collect your profits, however; they want to know what do you do financially outside the US. So what are some penalties for not filing the FBAR? Well, they are frankly quite steep, reaching up to $500,000 in penalties, or 10 years of imprisonment, or both. The goal is to sell one currency at the highest value and receive the most possible amount of coins in another currency. I've been using [Changelly](https://changelly.com/?ref_id=8bc42163701d) for a while now, without any issues. I've also used ShapeShift on some occasions since it supports a broader range of currencies/tokens, although [Changelly](https://changelly.com/?ref_id=8bc42163701d) has been expanding their support widely in the recent weeks. The reason I've been preferring [Changelly](https://changelly.com/?ref_id=8bc42163701d) over ShapeShift is because I've read some pretty bad reviews on how people lost money when their Shapeshift exchange transactions failed. Well, yesterday, for the very first time, one of my [Changelly](https://changelly.com/?ref_id=8bc42163701d) transactions failed.  At first I freaked out. Then a sudden realization came to me that if I lost my money, it's only about $118 worth. I could live with that. But better, there had to be a way to straighten it out. I quickly found a contact for [Changelly](https://changelly.com/?ref_id=8bc42163701d) Support and emailed them with screenshots at [email protected]. I immediately received the following automated response:  Just a few minutes later I received a reply from a real person:  Then this morning I received the following email:  I was able to confirm that my wallet received the missing tokens. All in all, I must admit I did not expect this level of support. Reading about some of the experiences people have had I was sure my request was going to never be answered. I not only received a very fast response, but also did not have to jump through any hoops to get my tokens back. |

| body | A Michigan man has been charged with running an unlicensed money transmitting business after selling nearly $150,000 in bitcoin online. According to an indictment released by Detroit TV news services WD-IV Friday, 52-year-old Bradley Anthony Stetkiw ran an exchange through the LocalBitcoins website, conducting transactions at restaurants in the Bloomfield area. Stetkiw is alleged to have sold bitcoin as part of a business venture for approximately two years, at a volume that would make him subject to federal anti-money laundering regulations. Of the total, the documents, filed with the U.S. District Court for the Eastern District of Michigan, assert Stetkiw sold more than $56,000 worth of bitcoin to federal agents through six meetings. According to the indictment: "Operating under the user name 'SaltandPepper,' Stetkiw bought, sold and brokered deals for hundreds of thousands of dollars in bitcoins while failing to comply with the money transmitting business registration requirements set fort in Title 31, United States Code, Section 5330." The authorities are going after individuals who are operating unlicensed cryptocurrency exchanges. Stetkiw is notably not the first LocalBitcoins user to be charged for trading bitcoin. Earlier this year, Detroit resident Sal Mansy plead guilty to the charge of operating an unlicensed money services business. He allegedly conducted $2.4 million-worth of transactions over a two-year period ending in July 2015. Other arrests in Missouri and New York suggest actions against independent U.S. bitcoin sellers are becoming more commonplace. Last year, a Louisiana chiropractor and his son pleaded guilty to operating an unlicensed money servicing business in which they sold over $3.5 million USD in Bitcoin for fiat currency. Recently, a Florida programmer got sentenced to 16 months in jail for his part in a Bitcoin laundering scheme. The Treasury Department’s Financial Crimes Enforcement Network (FinCEN) did issue a document in 2013 that stated that users of cryptocurrencies were not money servicing businesses, but those who engage in exchanging those currencies were. The agency said: "A user is a person that obtains virtual currency to purchase goods or services. An exchanger is a person engaged as a business in the exchange of virtual currency for real currency, funds, or other virtual currency." | body | Alright, so we've all heard about Bitconnect now, the coin and lending system labeled as the crypto ponzi scheme. Believe me, I'm not here to defend it. I've been doing very well in my life not falling for scams or just anything that sounds too good to be true. I've even been asked by friends on multiple occasions to join their pyramids and I sat in a couple of presentations where I witnessed people blindly write their checks to get in on the opportunity promising big rewards. All too good to be true. I believe in hard work. I'm not an entrepreneur and I'm not a salesman by nature. It takes a special kind of a person to be successful in the business of selling. And it takes a genius to recruit people and sign them up to sell overpriced garbage no one in the world wants. But it seems there is something different and intriguing about this Bitconnect pyramid system. Yes, it's true their website is terrible and full of grammar mistakes (so is probably my post as I'm not a native English speaker), it's true no one was able to locate their office in England, and it's true that no one can find any information on how this system actually works. I'm going to put myself in line with all those who believe there is something very fishy about all of this and that this system can't sustain itself long term. But then there is also the other side of the coin. I've seen some posts and watched videos that actually can be a little compelling as to why this may not be a scam after all. Check out this video, as an example. I don't fully understand it, but it seems to make some sense on the surface: https://youtu.be/zaPUs4oSr-Q And here's another video that provides some insight as to why we know so little about the people behind Bitconnect: https://youtu.be/CCXFK7DVaWA So, what do I conclude? Maybe it is a scam, or maybe it is not. I don't know. I hesitate but I'm leaning towards the "yes" here, because I also simply can't ignore the hundreds of YouTube videos featuring people showing off their account balances. In the end I decided that I'll take some extra cash sitting around that invest it to see for myself. I only invested $1060, which is the most I'm willing to play around with and be okay with never seeing again should this whole thing implode. My original investment is now locked in for 239 days. I have calculated (using this spreadsheet: https://bitconnectmoney.com/bitcoin-excel-spreadsheet/) that at 0.8% daily interest rate (which apparently seems to be quite conservative) I will collect $1060 in interest (without reinvestments) in 125 days. This way I will have recouped my original investment back in 4 months, after which I will start reinvesting the incoming interest payouts without any fear of loosing my original investment. In reality, I will probably tweak my system as I go. I will likely reinvest some of the interest and cash out a part of it back to bitconnect and bitcoin wallet. Both bitconnect and bitcoin coins are increasing in their value, and once I see I cashed out my original $1060 investment I will continue playing the lending game without a fear of loosing it. I guess what I am saying is that I will try out this "ponzi" scheme and see if I can play it out for a few months. So that's it, that's my take. I advise you all to research and weigh your options, and consider that if you have any extra cash to burn you will not find a better place to invest it, at least for now. Sometimes it's lack of experience, sometimes it's an accidental thing, sometimes there just isn't an explanation for what went wrong... (share your experience here, if you wish). For me, I owned my OPO for about 4 hours before things went wrong. First thing I did was I rooted it and installed TWRP. After creating a nandroid backup of the stock image I installed my favorite custom ROM and restored all my apps with TiBu. Everything was great and configured just the way I wanted it. I then wiped my old phone (Nexus 4), installed a new ROM and got it all ready for my wife. She was so excited to get rid of her GNex and move up to the N4. But then, for whatever reason, I opened an app on my OPO that I used to manage, download, and install kernels with. It came up with "there is a new kernel update!" and I instinctively clicked on "Install". 10 seconds later my phone was bricked. Nothing came on the screen, no fastboot, no recovery, nothing to boot to, no way to send data to and from it. The second the screen went black and the phone became lifeless I got that wretched feeling in my gut as I realized I just flashed a N4 kernel on my new OPO. Restoring the kernel management app with TiBu made it act like it's still running on my old phone, and in my excitement I didn't take a second to think things through... I received a bit of consolation when a quick XDA search revealed that I am not the only dumbass to brick his phone this very way. I joined forces with some pretty smart and desperate people and tried different things, all described in the following thread: http://forum.xda-developers.com/onep...t-adb-t2835696. Unfortunately it took us what seemed like many long weeks to figure it all out. Well, in the end a solution was found and I documented it in the the following post: http://forum.xda-developers.com/show...&postcount=136. This was a few months ago, but I recently noticed many people continue to search for these directions and have problems finding them hidden among many pages and other threads, so I've decided to put this stand alone thread with these, now updated, directions. Let me get one more thing straight, for the record. I did not find the way to unbrick the OPO. In fact I wasn't even the very first one to do it. It was a collective effort of few people who tried many different approaches and ideas, and I eventually documented these steps for others to follow. Being said, the following people deserve credit as well: @os_man, @rezor92, @Mnt-XDA. If I am forgetting other significant names and efforts, I apologize. ***CAUTION*** The following instructions are for hardware bricked devices ONLY and will not work on soft bricked devices. To determine whether your device is soft or hard bricked, click the button below: Hardware brick A hardware bricked OPO has nothing but a black screen (nothing ever comes on the screen, not even a boot logo), it might vibrate when a power button is pressed and held for 20 seconds, has no Recovery partition, no adb mode, and no fastboot partition. The device might be detected in Linux and you might be able to even send commands to it. In Windows, the bricked OPO should be detected as QHSUSB_BULK USB. You might have a bricked OPO as a result of flashing a kernel meant for a different device (or a ROM meant for another device that included a kernel), tinkering with the boot logo or bootloader, or your attempt of unlocking the bootloader resulted in corrupting the boot partition. Software brick Please do not attempt to use these directions if your phone is soft bricked. A software bricked OPO is one that might be stuck in a bootloop, but has a working bootloader, recovery partition, fastboot, or adb. If you press the power button and images appear on the screen and you are able to enter fastboot mode (Power + VolUP) or recovery (Power + VolDOWN) then your device is soft bricked. This thread does not encompass soft brick recovery, the instructions below do not apply and will not work on these phones. Consult other threads for help on soft bricked devices. If based on the above explanation of differences between soft and hard bricks you determined your device is hard bricked, here's what you will need to do... 1: Download Color.zip from https://goo.gl/iDby26 After downloading, unzip the archive on your computer. 2: Next, you need proper Windows drivers. There are architectural differences between Windows XP and Windows 7/8, so follow the directions below that pertain to you. One quick note about the drivers: the installation and process is very simple and straightforward on Windows XP (I also tested successfully on Windows 2003), but proves to be quite a challenge when running on Windows 7 or 8. Over and over people report issues when attempting the unbrick procedure on Windows 7/8, some have more luck than others. Being said, if you have access to a Windows XP computer, I highly recommend that you use that. If you have no choice but to use a Windows 7 or 8 computer and have problems, please share them here and read others' experiences. So first, by now you probably tried a few different things to fix your phone and you've already installed some drivers, including Qualcomm USB drivers for 9006 and 9008. My best advice is to uninstall the drivers you tried so far and use the ones listed below. Go to Device Manager, right click on the bricked USB device (QHSUSB_BULK or Qualcomm HS-USB QDLoader 9008) and go to Properties, click on Driver, then select Uninstall. Check the box to remove driver files, if prompted. Then: 2a: Windows XP users: You are in luck, driver installation is straightforward. Go to the extracted Color.zip folder and find Driver.iso. Extract Driver.iso. Inside the extracted folder find Setup.exe. Run Setup.exe to install the drivers. The installer is Chinese, but all you need to do is click through the prompts. 2b: Windows 7 and Windows 8: These operating systems block unsigned driver installations by default. Follow these steps (thanks @nag4pl for testing these): Download and extract these Qualcomm 2012 drivers: https://goo.gl/cIKnFZ. Connect your bricked phone and let Windows do its thing. Now something very essential you need to do here is to execute two commands to allow you to install unsigned drivers for QHUSB_BULK. Click on Start Menu > Type cmd.exe > Right Click and Run as Administrator. In the CMD window type in the following commands (hit enter after each): bcdedit.exe -set loadoptions DDISABLE_INTEGRITY_CHECKS bcdedit.exe -set TESTSIGNING ON After both the commands should run successfully, restart your computer. You can now proceed to install unsigned drivers from the file you downloaded. Open Device Manager, you should be seeing ugly yellow warning under other devices for QHUSB_BULK. Right click on the name and select Update Driver Software > Browse my Computer for driver software. For driver software location provide the path where you have extracted Qualcomm 2012 drivers you downloaded and make sure 'Include Subfolders' is checked. Proceed through all the installation prompts ignoring any warnings. 3: Once you have the drivers straightened out, connect your bricked phone to the computer and start it up by holding VolUp + Power to about 10 seconds, and let the computer do its thing. Don't install drivers if they are not installed by itself. Instead launch Msm8974DownloadTool.exe as Administrator (right click on Msm8974DownloadTool.exe and select "Run as administrator") from the extracted Color.zip archive. It will scan all the COM ports and find the phone. That's the one line that looks different in the list. The list is just a list of your com ports and devices. If you unplug the phone and move it to another port, it will show your bricked phone on a different line. Clicking on "Enum" just rescans the busses. Clicking the big square button in upper right corner scans the phone and reports what's good and what's not. It takes a minute for the scan to finish. If you don't see your phone in the list of com devices, try unplugging/plugging in your phone a couple times, and rebooting it with VolUP + Power (hold 10 seconds). You will see it in Device Manager as well. Once you see the phone in the list, click Start. You should see the programs start writing different files to the phone. Each time it writes a file you'll see a progress bar. Once you see this process happening, smile, you know you will be good to go... After all files are written, the com line with your device will turn green. You're good, unplug and reboot your phone. It will boot to ColorOS, the Chinese OS that comes on OPO. 4: Optional Steps: Your phone is no longer bricked. You now have a few options to get back to stock. The easiest way is to use a toolkit from http://forum.xda-developers.com/onep...9-gui-t2807418, or you can flash an image manually by following directions from: http://forum.xda-developers.com/onep...stock-t2826541. Download the proper image zip and after extracting it, run the following commands in fastboot mode: fastboot flash boot boot.img fastboot flash userdata userdata.img fastboot flash system system.img fastboot flash recovery recovery.img fastboot flash cache cache.img fastboot flash modem NON-HLOS.bin fastboot flash sbl1 sbl1.mbn fastboot flash dbi sdi.mbn fastboot flash aboot emmc_appsboot.mbn fastboot flash rpm rpm.mbn fastboot flash tz tz.mbn fastboot flash LOGO logo.bin Make sure you have the proper image. I accidentally installed the 16GB version on my 64GB OPO first time and obviously didn't get 64GB of space. Instead launch Msm8974DownloadTool.exe as Administrator (right click on Msm8974DownloadTool.exe and select \"Run as administrator\") from the extracted Color.zip archive. It will scan all the COM ports and find the phone. That's the one line that looks different in the list. The list is just a list of your com ports and devices. If you unplug the phone and move it to another port, it will show your bricked phone on a different line. \n\nClicking on \"Enum\" just rescans the busses. Clicking the big square button in upper right corner scans the phone and reports what's good and what's not. It takes a minute for the scan to finish.\n\nIf you don't see your phone in the list of com devices, try unplugging/plugging in your phone a couple times, and rebooting it with VolUP + Power (hold 10 seconds). You will see it in Device Manager as well.\n\nOnce you see the phone in the list, click Start. You should see the programs start writing different files to the phone. Each time it writes a file you'll see a progress bar. Once you see this process happening, smile, you know you will be good to go... After all files are written, the com line with your device will turn green. You're good, unplug and reboot your phone. Furthermore, the guy was not able to get any answers as to exactly what warranted the bank's action, nor was he able to get his money. Bank of America stated they will mail him a cashier's check, but would not even give him an ETA. The transfer from Coinbase did include "BTC" in the payer's name. Perhaps that's what tipped the bank off. This shows the extend the big banks will go to make the lives harder for all those who perform crypto transactions outside of the banking system.
