Sumado a esto tenemos la responsabilidad de ampliar la capacidad de los usuarios de participar en los sistemas de consenso que son parte de lo que hacen operar efectivamente la tecnología descentralizada. # <center>Hoy traemos para ustedes un proyecto de Equilibrium, basado en REX.</center> REX se enfoca en la creación de plataformas que brindan oportunidades a todos los usuarios de EOS. Pero no solo esto: REX trabaja de la mano de Equilibrium para garantizar que la operatividad de la plataforma esté abierta para todo aquel que deseen incorporarse de forma efectiva con esta red. Su nueva innovación consta de un proceso de 3 fases que hará que sea posible que usuarios de todo el mundo puedan participar de forma libre en la elección de block producers de EOS. “Equilibrium Proxy” funciona como la primera fase, y viene de la mano de un destaking de REX con los colaterales que se encuentran vinculados a EOS. Esto permite al sistema establecer un proxy con un fondo común entre los usuarios, siendo este proxy un depósito de las recompensas REX colateralizadas en EOS. Esto para al final del dia, garantizar un staking en de Equilibrium a REX lo que le permite funcionar efectivamente como representante de votaciones con un peso significativo. Las otras dos fases se componen del token NUT, que representa un sistema para pago y de representación proxy por medio de Equilibrium. La ventaja de este sistema es que promueve votos off chain, brindando a todos los interesados en blockchain la oportunidad de participar en los procesos de gobernanza del sistema. Este proceso inicia oficialmente el 3 de julio, ofreciendo a las personas a partir de las 3:00pm GMT la posibilidad de votar BPs de forma fácil y cómoda. ## ¿Cómo votar por tu BP de preferencia en el Proxy de Equilibrium? * Entra al link de votación de la plataforma de Equilibrium - [Link de Votación](https://voting.eosdt.com/) * Elige de la lista tu Block Producer de preferencia. * Selecciona y presiona “Submit” al final de la forma. ## ¿Por qué votar con un Proxy como Equilibrium? | body | ## <center>Established Obligations in the Venezuelan Legal Framework for Domestic and Foreign Companies Wishing to Engage in Commercial Activities Regarding Digital Mining, Blockchain, Trading and Other and Conexus Activities.</center>  With the enforcement of the "*Ley del Sistema Integral de Criptoactivos*" (in English: “*Law of Integral Cryptoassets System*”) on January 30, 2019 and the subsequent promulgation of another rule called "*Providencia mediante la cual se regula el Registro Integral de Servicios de Criptoactivos*" (In English “*Providence regulating the Comprehensive Registry of Cryptoactive Services*”) on February 4, 2019, Venezuela already has a series of legal bases that will generally govern and regulate multiple service activities, along with its different commercial relations of the companies and natural persons, that have as activity the exchange and operation of cryptoactives, blockchain, trading, digital mining and its different related and conexus activities, given that these regulations allow and give a character of legitimacy and legality to the multiple activities before mentioned given these have some form of representation and commercialization within the Venezuelan territory. It is important to point out and clarify, in accordance with the preceding paragraph, that the Law and its Providence cover in principle companies and natural persons whose fiscal residency is within the Bolivarian Republic of Venezuela; however, in the case of foreign companies or legal persons whose domicile is outside Venezuela and who wish to exercise activities of services, operation, issuance, exchange of cryptoactives, blockchain, trading, digital mining and its various related activities, are also subject to the application of the rule as long as their activity and operability is to be exercised in a face-to-face manner within the Venezuelan jurisdiction or territory and that simultaneously there is a physical and tangible presence of individuals, workers or representatives of foreign companies, as well as a physical and tangible presence of mining objects and equipment or computer or electronic devices; since in the event that foreign companies are not going to have a presence of personnel or electronic equipment in Venezuela, they are not subject to the mandatory provisions of the Law and its Providence, since these two (2) legal provisions do not enjoy "extraterritoriality", due to the fact that it is a rule created and promulgated only to exercise its authority within Venezuelan territory. Established the above and to the existence of a juridical framework already promulgated in Venezuela, is to analyze according to the law that these two (2) norms are of obligatory fulfillment within the Venezuelan jurisdiction and it is to emphasize that the first step so that the natural and juridical persons that are foreign or not that wish to carry out activities like exchange of goods, services, values, operation, exchange of cryptoactives, blockchain, trading, is the “registration” in order to obtain the RISEC, which is the authorization or license granted by the Venezuelan State through the Law to natural and juridical persons to legally practice the different digital mining activities and their different forms of services, functionality, exchange and commercialization. Upon knowing the above, the Article 30 of the Law of the Integral System of Cryptoactives, defines the obligation of "registration" for natural and legal persons who intend to develop and/or are already developing in Venezuelan soil any commercial activity with cryptoactives and their various activities of exchange and commercialization that are related and will be through a record of information, which will be administered through the National Superintendence of Cryptoactives (SUNACRIP) and will have its main office in the City of Caracas, who will inspect and supervise it, since SUNACRIP (for its acronym in Spanish) is a public entity created by Law to supervise and regulate everything related to the virtual mining sector of cryptoassets and its other activities of services, exchange, stock, issuance and operation. However, the steps to be followed by individuals or companies residing in Venezuela or foreign companies that have any type of interest in having personnel presence or any electronic, computer or mining equipment and that intend to make some kind of commercialization, exchange of cryptoactive services and their functioning, blockchain, trading, digital mining and its various conexus and related activities within the national territory, must comply compulsorily with the provisions of the aforementioned Article 30 of the Law of the Integral System of Cryptoactives to obtain the RISEC through registration, procedure that is established in Articles 8 and 9 of the "*Providence through which regulates the Integral Registry of Cryptoactives Services*", in which the aforementioned articles constitute the steps that must be complied with to obtain the authorization, together with a series of requirements, which are detailed below: **Article 8.-** Enter the web portal [www.sunacrip.gob.ve](www.sunacrip.gob.ve) to register and access the RISEC platform, then complete and accept the requested questionnaire, which are identification and address of natural or legal persons, identification of their representatives, digital subscription of the Affidavit that the funds allocated come from lawful activities, as well as other documents required in Article 9 must be uploaded digitally, which are: **Article 9.-** *Natural Person*: - Valid Identity Card or Passport. - Front Facing Photo - Any other document requested by SUNACRIP. (May be interpreted as invoices for mining equipment, computer equipment, address identification.) *Juridical Person*: - Company Tax Information Register or "Registro de Información Fiscal" (RIF). - Authenticated or registered document to certify legal representation or power of attorney (in case the shareholder or owner of the company does not register). - Frontal photo of the attorney or legal representative. - Articles of Incorporation and Articles of Association of the company and their amendments. - Any other document requested by SUNACRIP. (May be interpreted as invoices for mining equipment, computer equipment, address identification.) Following this procedure, after verifying the documents and the required information, SUNACRIP will digitally issue a RISEC number or code to identify the company or natural person that registered, which upon obtaining this identification will allow the user to operate and administer within Venezuelan territory everything related to the world of cryptoassets and its various related forms of exchange, operation and commercialization, Blockchain, Trading, Exchange, Digital Wallets; thus avoid the sanctions established in the Law of the Integral System of Cryptoactives. That is why it is important that both companies and individuals comply with the indispensable and mandatory requirement of registration to obtain their RISEC number for the purpose it possesses and counts with a means or defense mechanism at the time that SUNACRIP performs an inspection or auditing and thus avoid being denied or revoked to perform any activity under this context, or in some cases be sanctioned, fined or confiscated improperly by SUNACRIP, since these attributions that this public entity has in relation to inspections and their possible sanctions are established in articles 34 and 37 of the Integral Cryptoactive System Law, given that article 34 constitutes the procedure to be followed (inspection or auditing) in case of non-compliance with the Law and/or the Providence, for example not having the registration with the SUNACRIP and obtaining the RISEC and Article 37 establishes the sanctions that can apply to natural or legal persons who are found in violation of the Law and / or Providence, which are transcribed below for further knowledge: **Article 34.-** “The National Superintendence of Cryptoactives and Related Activities of Venezuela SUNACRIP, through the competent intendancy and making use of the most suitable technical means, shall inspect the activities of the cryptoactives sector, in order to determine the truth of the facts, which allow to know the conformity or non-compliance of the duties established by this Constituent Decree, those responsible, the degree of responsibility and, if applicable, the damage incurred". *First Paragraph.-* It may rely on competent public authorities where there is a presumption that security, environmental protection, prices and public services may be affected". **Article 37.-** “If during the inspection or inspection, the civil servant or official acting detects signs of non-compliance with the obligations established in this Constituent Decree, and there are elements that allow the presumption that serious harm or injuries of difficult reparation to the community may be caused; they may adopt and execute in the same act, preventive measures designed to prevent that the norms that regulate the matter continue to be broken, in accordance with the applicable legal system”. Such measures may consist of: - Confiscation. - Suspension of Licenses, permits or authorizations issued by the National Superintendence of Cryptoactives and Related Activities (SUNACRIP). - Any other provision in the legal system to prevent the violation of the citizens' rights. When the measure of confiscation of mining equipment is ordered, the Superintendency shall guard the respective assets, which, if the measure remains firm, may be disposed of for social purposes by means of a reasoned act to which the Superintendent shall subscribe for such purpose. In this sense, and after observing what is stipulated in articles 34 and 37 of the Law, where it explicitly establishes sanctions for non-compliance with its provisions, it is recommended that any natural or legal person residing in Venezuela or abroad, who wishes to enter and/or is already entering the world of digital mining, both physically and in person, within the Venezuelan jurisdiction, its services, operation, blockchain and any other form of marketing and exchange of the same, may do so without any restriction or limitation, provided that the actions are appropriate and comply with the provisions of the Act, ie must meet the requirement to "register" with the National Superintendence of Cryptoactives (SUNACRIP) to obtain its RISEC. It is also important to point out that this authorization or license indicated as RISEC is comprehensive, which means that the companies and natural persons that obtain it have the advantage to operate the virtual mining sector "in Venezuela", "for Venezuela" and "abroad", in a comprehensive and legal manner, since the same Law within the provisions does not establish restrictions for the user who acquires it, which could be interpreted as being able to operate, commercialize and exchange goods, services, stocks and any form of digital mining, as well as exercise Blockchain, Digital Wallets, Purchase and Sale of the different Cryptoactives, Exchange, Trading and any other related activity without any limitation. In consequence and to culminate in base to these principles it is to indicate, that all those individuals as much natural as juridical that have the intention to exercise and to develop the commercialization, exchange of goods and services, to practice the digital mining and its operation, Blockchain, Digital Wallets, Purchase and Sale of the different Cryptoactives, Exchange, Trading and any other related activity and similar that is domiciled in Venezuela must register with the National Superintendence of CrIptoactives to obtain its RISEC license and thus will be authorized to operate this large sector from and for the national territory and even abroad; and also legal persons domiciled outside the national territory (foreign) who have or are going to have any type of electronic devices, computing or digital mining and any personnel and/or representative who want to operate and provide their services within the Venezuelan territory on any activity related to the purchase and sale of Cryptoactive and its various marketing activities, operation and exchange of goods, securities and services, Blockchain, Digital Wallets, Exchange, Trading and any other related and related activity, must go to SUNACRIP to notify its intention and purpose, since otherwise by not making the registration, may be subject to the sanctions established in the regulation. | body | ## <center>Established Obligations in the Venezuelan Legal Framework for Domestic and Foreign Companies Wishing to Engage in Commercial Activities Regarding Digital Mining, Blockchain, Trading and Other and Conexus Activities.</center>  With the enforcement of the "*Ley del Sistema Integral de Criptoactivos*" (in English: “*Law of Integral Cryptoassets System*”) on January 30, 2019 and the subsequent promulgation of another rule called "*Providencia mediante la cual se regula el Registro Integral de Servicios de Criptoactivos*" (In English “*Providence regulating the Comprehensive Registry of Cryptoactive Services*”) on February 4, 2019, Venezuela already has a series of legal bases that will generally govern and regulate multiple service activities, along with its different commercial relations of the companies and natural persons, that have as activity the exchange and operation of cryptoactives, blockchain, trading, digital mining and its different related and conexus activities, given that these regulations allow and give a character of legitimacy and legality to the multiple activities before mentioned given these have some form of representation and commercialization within the Venezuelan territory. It is important to point out and clarify, in accordance with the preceding paragraph, that the Law and its Providence cover in principle companies and natural persons whose fiscal residency is within the Bolivarian Republic of Venezuela; however, in the case of foreign companies or legal persons whose domicile is outside Venezuela and who wish to exercise activities of services, operation, issuance, exchange of cryptoactives, blockchain, trading, digital mining and its various related activities, are also subject to the application of the rule as long as their activity and operability is to be exercised in a face-to-face manner within the Venezuelan jurisdiction or territory and that simultaneously there is a physical and tangible presence of individuals, workers or representatives of foreign companies, as well as a physical and tangible presence of mining objects and equipment or computer or electronic devices; since in the event that foreign companies are not going to have a presence of personnel or electronic equipment in Venezuela, they are not subject to the mandatory provisions of the Law and its Providence, since these two (2) legal provisions do not enjoy "extraterritoriality", due to the fact that it is a rule created and promulgated only to exercise its authority within Venezuelan territory. Established the above and to the existence of a juridical framework already promulgated in Venezuela, is to analyze according to the law that these two (2) norms are of obligatory fulfillment within the Venezuelan jurisdiction and it is to emphasize that the first step so that the natural and juridical persons that are foreign or not that wish to carry out activities like exchange of goods, services, values, operation, exchange of cryptoactives, blockchain, trading, is the “registration” in order to obtain the RISEC, which is the authorization or license granted by the Venezuelan State through the Law to natural and juridical persons to legally practice the different digital mining activities and their different forms of services, functionality, exchange and commercialization. Upon knowing the above, the Article 30 of the Law of the Integral System of Cryptoactives, defines the obligation of "registration" for natural and legal persons who intend to develop and/or are already developing in Venezuelan soil any commercial activity with cryptoactives and their various activities of exchange and commercialization that are related and will be through a record of information, which will be administered through the National Superintendence of Cryptoactives (SUNACRIP) and will have its main office in the City of Caracas, who will inspect and supervise it, since SUNACRIP (for its acronym in Spanish) is a public entity created by Law to supervise and regulate everything related to the virtual mining sector of cryptoassets and its other activities of services, exchange, stock, issuance and operation. However, the steps to be followed by individuals or companies residing in Venezuela or foreign companies that have any type of interest in having personnel presence or any electronic, computer or mining equipment and that intend to make some kind of commercialization, exchange of cryptoactive services and their functioning, blockchain, trading, digital mining and its various conexus and related activities within the national territory, must comply compulsorily with the provisions of the aforementioned Article 30 of the Law of the Integral System of Cryptoactives to obtain the RISEC through registration, procedure that is established in Articles 8 and 9 of the "*Providence through which regulates the Integral Registry of Cryptoactives Services*", in which the aforementioned articles constitute the steps that must be complied with to obtain the authorization, together with a series of requirements, which are detailed below: **Article 8.-** Enter the web portal [www.sunacrip.gob.ve](www.sunacrip.gob.ve) to register and access the RISEC platform, then complete and accept the requested questionnaire, which are identification and address of natural or legal persons, identification of their representatives, digital subscription of the Affidavit that the funds allocated come from lawful activities, as well as other documents required in Article 9 must be uploaded digitally, which are: **Article 9.-** *Natural Person*: - Valid Identity Card or Passport. - Front Facing Photo - Any other document requested by SUNACRIP. (May be interpreted as invoices for mining equipment, computer equipment, address identification.) *Juridical Person*: - Company Tax Information Register or "Registro de Información Fiscal" (RIF). - Authenticated or registered document to certify legal representation or power of attorney (in case the shareholder or owner of the company does not register). - Frontal photo of the attorney or legal representative. - Articles of Incorporation and Articles of Association of the company and their amendments. - Any other document requested by SUNACRIP. (May be interpreted as invoices for mining equipment, computer equipment, address identification.) Following this procedure, after verifying the documents and the required information, SUNACRIP will digitally issue a RISEC number or code to identify the company or natural person that registered, which upon obtaining this identification will allow the user to operate and administer within Venezuelan territory everything related to the world of cryptoassets and its various related forms of exchange, operation and commercialization, Blockchain, Trading, Exchange, Digital Wallets; thus avoid the sanctions established in the Law of the Integral System of Cryptoactives. That is why it is important that both companies and individuals comply with the indispensable and mandatory requirement of registration to obtain their RISEC number for the purpose it possesses and counts with a means or defense mechanism at the time that SUNACRIP performs an inspection or auditing and thus avoid being denied or revoked to perform any activity under this context, or in some cases be sanctioned, fined or confiscated improperly by SUNACRIP, since these attributions that this public entity has in relation to inspections and their possible sanctions are established in articles 34 and 37 of the Integral Cryptoactive System Law, given that article 34 constitutes the procedure to be followed (inspection or auditing) in case of non-compliance with the Law and/or the Providence, for example not having the registration with the SUNACRIP and obtaining the RISEC and Article 37 establishes the sanctions that can apply to natural or legal persons who are found in violation of the Law and / or Providence, which are transcribed below for further knowledge: **Article 34.-** “The National Superintendence of Cryptoactives and Related Activities of Venezuela SUNACRIP, through the competent intendancy and making use of the most suitable technical means, shall inspect the activities of the cryptoactives sector, in order to determine the truth of the facts, which allow to know the conformity or non-compliance of the duties established by this Constituent Decree, those responsible, the degree of responsibility and, if applicable, the damage incurred". *First Paragraph.-* It may rely on competent public authorities where there is a presumption that security, environmental protection, prices and public services may be affected". **Article 37.-** “If during the inspection or inspection, the civil servant or official acting detects signs of non-compliance with the obligations established in this Constituent Decree, and there are elements that allow the presumption that serious harm or injuries of difficult reparation to the community may be caused; they may adopt and execute in the same act, preventive measures designed to prevent that the norms that regulate the matter continue to be broken, in accordance with the applicable legal system”. Such measures may consist of: - Confiscation. - Suspension of Licenses, permits or authorizations issued by the National Superintendence of Cryptoactives and Related Activities (SUNACRIP). - Any other provision in the legal system to prevent the violation of the citizens' rights. When the measure of confiscation of mining equipment is ordered, the Superintendency shall guard the respective assets, which, if the measure remains firm, may be disposed of for social purposes by means of a reasoned act to which the Superintendent shall subscribe for such purpose. In this sense, and after observing what is stipulated in articles 34 and 37 of the Law, where it explicitly establishes sanctions for non-compliance with its provisions, it is recommended that any natural or legal person residing in Venezuela or abroad, who wishes to enter and/or is already entering the world of digital mining, both physically and in person, within the Venezuelan jurisdiction, its services, operation, blockchain and any other form of marketing and exchange of the same, may do so without any restriction or limitation, provided that the actions are appropriate and comply with the provisions of the Act, ie must meet the requirement to "register" with the National Superintendence of Cryptoactives (SUNACRIP) to obtain its RISEC. It is also important to point out that this authorization or license indicated as RISEC is comprehensive, which means that the companies and natural persons that obtain it have the advantage to operate the virtual mining sector "in Venezuela", "for Venezuela" and "abroad", in a comprehensive and legal manner, since the same Law within the provisions does not establish restrictions for the user who acquires it, which could be interpreted as being able to operate, commercialize and exchange goods, services, stocks and any form of digital mining, as well as exercise Blockchain, Digital Wallets, Purchase and Sale of the different Cryptoactives, Exchange, Trading and any other related activity without any limitation. In consequence and to culminate in base to these principles it is to indicate, that all those individuals as much natural as juridical that have the intention to exercise and to develop the commercialization, exchange of goods and services, to practice the digital mining and its operation, Blockchain, Digital Wallets, Purchase and Sale of the different Cryptoactives, Exchange, Trading and any other related activity and similar that is domiciled in Venezuela must register with the National Superintendence of CrIptoactives to obtain its RISEC license and thus will be authorized to operate this large sector from and for the national territory and even abroad; and also legal persons domiciled outside the national territory (foreign) who have or are going to have any type of electronic devices, computing or digital mining and any personnel and/or representative who want to operate and provide their services within the Venezuelan territory on any activity related to the purchase and sale of Cryptoactive and its various marketing activities, operation and exchange of goods, securities and services, Blockchain, Digital Wallets, Exchange, Trading and any other related and related activity, must go to SUNACRIP to notify its intention and purpose, since otherwise by not making the registration, may be subject to the sanctions established in the regulation. |

| body | ## <center>“OBLIGACIONES ESTABLECIDAS EN EL MARCO LEGAL VENEZOLANO PARA LAS EMPRESAS NACIONALES Y EXTRANJERAS QUE DESEEN EJERCER ACTIVIDADES COMERCIALES DE MINERIA DIGITAL, BLOCKCHAIN, TRADING Y SUS OTRAS ACTIVIDADES AFINES Y CONEXAS"</center>  Con la entrada en vigencia de la *“Ley del Sistema Integral de Criptoactivos”* en fecha 30 de enero de 2019 y la posterior promulgación de otra norma denominada “*Providencia mediante la cual se regula el Registro Integral de Servicios de Criptoactivos*” en fecha 04 de febrero de 2019, en Venezuela ya se cuenta con una serie de bases legales que regirán y regularán de forma general las múltiples actividades de servicios, operatividad y sus diferentes relaciones comerciales de las empresas y personas naturales, que tengan como actividad el intercambio y funcionamiento de criptoactivos, blockchain, trading, minería digital y sus distintas actividades conexas y afines, dado que estas normativas permiten y le dan carácter de legitimidad y legalidad a todas estas múltiples actividades antes mencionadas y que tengan alguna forma de representación y comercialización dentro del territorio venezolano. Es importante señalar y aclarar en concordancia con el párrafo anterior, que la Ley y su Providencia abarcan en su contenido en principio a las empresas y personas naturales que tengan su domicilio fiscal en la República Bolivariana de Venezuela; sin embargo en el caso de las empresas o personas jurídicas extranjeras que su domicilio sea fuera de Venezuela y quieran ejercer actividades de servicios, funcionamiento, emisión, intercambio de criptoactivos, blockchain, trading, minería digital y sus distintas actividades afines, también son objeto de la aplicación de la norma siempre y cuando su actividad y operatividad vaya ser ejercida de forma presencial dentro de la jurisdicción o del territorio venezolano y que simultáneamente concurran una presencia física y tangible tanto de personas, trabajadores o representantes de las empresas extranjeras, así como presencia física y tangible de objetos y equipos de minería o dispositivos de computación o electrónicos; ya que en el caso de que están empresas extranjeras no vayan a tener presencia ni de personal, ni de equipos electrónicos en Venezuela no están bajo la obligatoriedad de las disposiciones de la Ley y su Providencia, toda vez que estas dos (2) disposiciones legales no gozan de “extraterritorialidad”, debido a que es una norma creada y promulgada solo para ejercer su autoridad dentro del territorio venezolano. Establecido lo anterior y al existir un marco jurídico ya promulgado en Venezuela, es de analizar conforme al derecho que estas dos (2) normativas son de obligatorio cumplimiento dentro de la jurisdicción venezolana y es de resaltar que el primer paso para que las personas naturales y jurídicas y que sean extranjeras o no que deseen realizar actividades como intercambio de bienes, servicios, valores, funcionamiento, intercambio de criptoactivos, blockchain, trading, minería digital y sus distintas actividades conexas, dentro del territorio venezolano, deben cumplir con el primer requisito que es la “inscripción” para obtener el RISEC, que es la autorización o licencia que otorga el Estado Venezolano a través de la Ley a las personas naturales y jurídicas para que practiquen de forma legal las distintas actividades de minerías digital y sus diferentes formas de servicios, funcionabilidad, intercambio y comercialización. Al conocer lo anterior, el artículo 30 de la Ley del Sistema Integral de Criptoactivos, define la obligatoriedad de la “inscripción” para las personas naturales y jurídicas que pretendan desarrollar y/o ya estén desarrollando bajo suelo venezolano cualquier actividad comercial con criptoactivos y sus distintas actividades de intercambio y comercialización que sean afines y será a través de un registro de información, que se administrará a través de la Superintendencia Nacional de Criptoactivos (SUNACRIP) y tendrá su desde principal en la Ciudad de Caracas, quién la inspeccionará y supervisará, toda vez que la SUNACRIP (por sus siglas en castellano) es el ente público creado por la Ley para supervisar y regular todo lo referente al sector minero virtual de criptoactivos y sus demás actividades de servicios, intercambio, valores, emisión y funcionamiento. Ahora bien, los pasos a seguir para que las personas naturales o empresas domiciliadas en Venezuela o las extranjeras que tengan algún tipo de interés de tener presencia de personal o de cualquier equipo electrónico, de computación o de minería y que tengan la intención de realizar algún tipo de comercialización, intercambio de servicios de criptoactivos y su funcionamiento, blockchain, trading, minería digital y sus distintas actividades conexas y afines dentro del territorio nacional, deben cumplir de forma obligatoria con lo establecido en el mencionado artículo 30 de la Ley del Sistema Integral de Criptoactivos para obtener el RISEC a través de la inscripción, procedimiento este que está establecido en los artículo 8 y 9 de la “Providencia mediante la cual regula el Registro Integral de Servicios de Criptoactivos”, la cual en los artículos antes señalados están constituidos los pasos que se debe cumplir para obtener la autorización, junto con una serie de requisitos, los cuales se detallan a continuación: **Artículo 8.-** Ingresar al portal web [www.sunacrip.gob.ve](www.sunacrip.gob.ve) para registrarse y poder acceder a la plataforma RISEC, luego completar y aceptar el cuestionario solicitado; los cuales son identificación y domicilio de las personas naturales o jurídicas, identificación de sus representantes, suscripción digital de la Declaración Jurada de que los fondos destinados provienen de actividades licitas, así como los demás documentos que se requieran en el artículo 9 deben ser cargados digitalmente, los cuales son: **Artículo 9.-** *Persona Natural:* - Cédula de identidad o Pasaporte vigente. - Foto Frontal - Cualquier otro documento solicitado por la SUNACRIP. (Bien pudiera interpretarse como facturas de equipos de minería, de computación, identificación del domicilio.) *Persona Jurídica:* - Registro de Información Fiscal de la empresa (RIF). - Documento autenticado o registrado para constar la representación legal o apoderado (en caso que no haga la inscripción el accionista o dueño de la empresa). - Foto frontal del apoderado o representante legal. - Acta Constitutiva y Estatutos Sociales de la empresa y sus modificaciones. - Cualquier otro documento que requiera la SUNACRIP. (Bien pudiera interpretarse como facturas de equipos de minería, de computación, identificación del domicilio.) Seguidamente a este trámite, la SUNACRIP luego de verificar los documentos, y la información requerida, procederá a emitir digitalmente un número o código de RISEC para identificar a la empresa o persona natural que se inscribió, la cual al obtener esta identificación ya le permitirá dentro del territorio venezolano operar y administrar al usuario todo lo relacionado con el mundo de los criptoactivos y sus distintas formas conexas de intercambio, funcionamiento y su comercialización, Blockchain, Trading, Exchange, Billeteras Digitales y evitar así las sanciones establecidas en la Ley del Sistema Integral de Criptoactivos. Es por ello que es importante que tanto las empresas o personas naturales cumplan con el requisito indispensable y obligatorio de inscripción para obtener su número RISEC con la finalidad que posea y cuente con un medio o mecanismo de defensa al momento de que la SUNACRIP le realice una inspección o fiscalización y de esta forma evitar que le nieguen o le revoquen realizar cualquier actividad bajo este contexto, o en algunos casos sea sancionado, multado o confiscado de forma indebida por la SUNACRIP, ya que estas atribuciones que posee este ente público en relación a las inspecciones y sus posibles sanciones están establecidos en los artículos 34 y 37 de la Ley del Sistema Integral de Criptoactivos, dado que el artículo 34 constituye el procedimiento a seguir (inspección o fiscalización) en caso de un incumplimiento a la Ley y/o a la Providencia, como por ejemplo no contar con la inscripción ante la SUNACRIP y obtener el RISEC y el artículo 37 establece las sanciones que les pueden aplicar a las personas naturales o jurídicas que se les determine una violación a la Ley y/o a la Providencia, los cuales se transcriben a continuación para mejor conocimiento **Artículo 34.-** “La Superintendencia Nacional de Criptoactivos y Actividades Conexas de Venezuela SUNACRIP, a través de la intendencia competente y haciendo uso de los medios técnicos más idóneos, inspeccionará las actividades propias del sector de criptoactivos, para determinar la verdad de los hechos, que permitan conocer la conformidad o incumplimiento de los deberes establecidos por este decreto Constituyente, los responsable, el grado de que responsabilidad y de ser procedente el daño causado”. Párrafo Primero.- Podrá apoyarse en organismos públicos competentes cuando se presuma la posible afectación de seguridad, de protección ambiental, de precios y de servicios públicos”. **Artículo 37.-** “Si durante la inspección o fiscalización, la funcionaria o funcionario actuante detectara indicios de incumplimiento de las obligaciones previstas en este Decreto Constituyente, y existieren elementos que permiten presumir que se puedan causar lesiones graves o de difícil reparación a la colectividad; podrán adoptar y ejecutar en el mismo acto, medidas preventivas destinadas a impedir que se continúen quebrantando las normas que regulan la materia, conforme al ordenamiento jurídico aplicable”. Dichas medidas podrán consistir en: - Comiso. - Suspensión de Licencias, permisos o autorizaciones emitidas por la Superintendencia Nacional de Criptoactivos y Actividades Conexas (SUNACRIP). - Cualquier otra prevista en el ordenamiento jurídico para impedir la vulneración de los derechos de los ciudadanos. Cuando se ordena la medida de comiso sobre los equipos de minería, la Superintendencia custodiará los respectivos bienes, los cuales en caso de quedar firme la medida, podrán ser dispuestos con fines sociales mediante acto motivado, que a tal efecto suscribirá el Superintendente. En este sentido y luego de observar lo estipulado en los artículos 34 y 37 de la Ley, donde de forma explícita establece sanciones por el incumplimiento de sus disposiciones, se recomienda que cualquier persona natural o jurídica domiciliada en Venezuela o en el Extranjero, que desee incursionar y/o ya esté incursionando de forma física y presencial dentro de la jurisdicción venezolana en el mundo de la minería digital, sus servicios, funcionamiento, blockchain y cualquier otra forma de comercialización e intercambio de las mismas, puede hacerlo sin ninguna restricción, ni limitación, siempre y cuando las actuaciones se adecuen y cumplan con las disposiciones de la Ley, es decir, deben cumplir el requisito de “inscribirse” ante la Superintendencia Nacional de Criptoactivos (SUNACRIP) para obtener su RISEC. Es importante señalar además que esta autorización o licencia señalada como RISEC es de forma amplia, es decir, las empresa y personas naturales que la obtengan tienen la ventaja para operar el sector minero virtual “en Venezuela”, “para Venezuela” y “para el Exterior”, en forma amplia y legal, toda vez que la misma Ley dentro de las disposiciones no establece restricciones para el usuario que la adquiera, lo que podría interpretarse que se podrá operar, comercializar e intercambiar bienes, servicios, valores y cualquier forma de minado digital, además podrán ejercer Blockchain, Billeteras Digitales, Compra y Venta de los distintos Criptoactivos, Exchange, Trading y cualquier otra actividad conexa sin ninguna limitación. En consecuencia y para culminar en base a estos principios es de señalar, que todas aquellas personas tanto naturales como jurídicas que tengan la intención de ejercer y desarrollar la comercialización, intercambio de bienes y servicios, practicar el minado digital y su funcionamiento, Blockchain, Billeteras Digitales, Compra y Venta de los distintos Criptoactivos, Exchange, Trading y cualquier otra actividad conexa y afines que su domicilio sea en Venezuela deberán inscribirse ante la Superintendencia Nacional de Criptoactivos para obtener su licencia RISEC y de esta forma quedarán autorizadas para operar ese amplio sector desde y para el territorio nacional e inclusive para el extranjero; e igualmente las personas jurídicas con domicilio fuera del territorio nacional (extranjeras) que tengan o vayan a tener algún tipo de dispositivos electrónicos, de computación, o de minería digital y algún personal y/o representante que quieran operar y dar sus servicios dentro del territorio venezolano sobre cualquier actividad relacionado con la compra y venta de Criptoactivos y sus distintas actividades de comercialización, funcionamiento e intercambio de bienes, valores y servicios, Blockchain, Billeteras Digitales, Exchange, Trading y cualquier otra actividad conexa y afines, deberán acudir ante la SUNACRIP a notificar su intención y propósito, dado que en caso contrario de no realizar la inscripción, podrán ser objetos de las sanciones establecidas en la norma. "body": "## <center>“OBLIGACIONES ESTABLECIDAS EN EL MARCO LEGAL VENEZOLANO PARA LAS EMPRESAS NACIONALES Y EXTRANJERAS QUE DESEEN EJERCER ACTIVIDADES COMERCIALES DE MINERIA DIGITAL, BLOCKCHAIN, TRADING Y SUS OTRAS ACTIVIDADES AFINES Y CONEXAS\"</center>\n\n\n\nCon la entrada en vigencia de la *“Ley del Sistema Integral de Criptoactivos”* en fecha 30 de enero de 2019 y la posterior promulgación de otra norma denominada “*Providencia mediante la cual se regula el Registro Integral de Servicios de Criptoactivos*” en fecha 04 de febrero de 2019, en Venezuela ya se cuenta con una serie de bases legales que regirán y regularán de forma general las múltiples actividades de servicios, operatividad y sus diferentes relaciones comerciales de las empresas y personas naturales, que tengan como actividad el intercambio y funcionamiento de criptoactivos, blockchain, trading, minería digital y sus distintas actividades conexas y afines, dado que estas normativas permiten y le dan carácter de legitimidad y legalidad a todas estas múltiples actividades antes mencionadas y que tengan alguna forma de representación y comercialización dentro del territorio venezolano. \n \nEs importante señalar y aclarar en concordancia con el párrafo anterior, que la Ley y su Providencia abarcan en su contenido en principio a las empresas y personas naturales que tengan su domicilio fiscal en la República Bolivariana de Venezuela; sin embargo en el caso de las empresas o personas jurídicas extranjeras que su domicilio sea fuera de Venezuela y quieran ejercer actividades de servicios, funcionamiento, emisión, intercambio de criptoactivos, blockchain, trading, minería digital y sus distintas actividades afines, también son objeto de la aplicación de la norma siempre y cuando su actividad y operatividad vaya ser ejercida de forma presencial dentro de la jurisdicción o del territorio venezolano y que simultáneamente concurran una presencia física y tangible tanto de personas, trabajadores o representantes de las empresas extranjeras, así como presencia física y tangible de objetos y equipos de minería o dispositivos de computación o electrónicos; ya que en el caso de que están empresas extranjeras no vayan a tener presencia ni de personal, ni de equipos electrónicos en Venezuela no están bajo la obligatoriedad de las disposiciones de la Ley y su Providencia, toda vez que estas dos (2) disposiciones legales no gozan de “extraterritorialidad”, debido a que es una norma creada y promulgada solo para ejercer su autoridad dentro del territorio venezolano.\n \n Establecido lo anterior y al existir un marco jurídico ya promulgado en Venezuela, es de analizar conforme al derecho que estas dos (2) normativas son de obligatorio cumplimiento dentro de la jurisdicción venezolana y es de resaltar que el primer paso para que las personas naturales y jurídicas y que sean extranjeras o no que deseen realizar actividades como intercambio de bienes, servicios, valores, funcionamiento, intercambio de criptoactivos, blockchain, trading, minería digital y sus distintas actividades conexas, dentro del territorio venezolano, deben cumplir con el primer requisito que es la “inscripción” para obtener el RISEC, que es la autorización o licencia que otorga el Estado Venezolano a través de la Ley a las personas naturales y jurídicas para que practiquen de forma legal las distintas actividades de minerías digital y sus diferentes formas de servicios, funcionabilidad, intercambio y comercialización. \n \n Al conocer lo anterior, el artículo 30 de la Ley del Sistema Integral de Criptoactivos, define la obligatoriedad de la “inscripción” para las personas naturales y jurídicas que pretendan desarrollar y/o ya estén desarrollando bajo suelo venezolano cualquier actividad comercial con criptoactivos y sus distintas actividades de intercambio y comercialización que sean afines y será a través de un registro de información, que se administrará a través de la Superintendencia Nacional de Criptoactivos (SUNACRIP) y tendrá su desde principal en la Ciudad de Caracas, quién la inspeccionará y supervisará, toda vez que la SUNACRIP (por sus siglas en castellano) es el ente público creado por la Ley para supervisar y regular todo lo referente al sector minero virtual de criptoactivos y sus demás actividades de servicios, intercambio, valores, emisión y funcionamiento.\n \nAhora bien, los pasos a seguir para que las personas naturales o empresas domiciliadas en Venezuela o las extranjeras que tengan algún tipo de interés de tener presencia de personal o de cualquier equipo electrónico, de computación o de minería y que tengan la intención de realizar algún tipo de comercialización, intercambio de servicios de criptoactivos y su funcionamiento, blockchain, trading, minería digital y sus distintas actividades conexas y afines dentro del territorio nacional, deben cumplir de forma obligatoria con lo establecido en el mencionado artículo 30 de la Ley del Sistema Integral de Criptoactivos para obtener el RISEC a través de la inscripción, procedimiento este que está establecido en los artículo 8 y 9 de la “Providencia mediante la cual regula el Registro Integral de Servicios de Criptoactivos”, la cual en los artículos antes señalados están constituidos los pasos que se debe cumplir para obtener la autorización, junto con una serie de requisitos, los cuales se detallan a continuación: \n\n**Artículo 8.-** Ingresar al portal web [www.sunacrip.gob.ve](www.sunacrip.gob.ve) para registrarse y poder acceder a la plataforma RISEC, luego completar y aceptar el cuestionario solicitado; los cuales son identificación y domicilio de las personas naturales o jurídicas, identificación de sus representantes, suscripción digital de la Declaración Jurada de que los fondos destinados provienen de actividades licitas, así como los demás documentos que se requieran en el artículo 9 deben ser cargados digitalmente, los cuales son:\n\n\n**Artículo 9.-** *Persona Natural:* \n - Cédula de identidad o Pasaporte vigente. \n - Foto Frontal \n - Cualquier otro documento solicitado por la SUNACRIP. (Bien pudiera interpretarse como facturas de equipos de minería, de computación, identificación del domicilio.) \n\n*Persona Jurídica:*\n - Registro de Información Fiscal de la empresa (RIF). \n - Documento autenticado o registrado para constar la representación legal o apoderado (en caso que no haga la inscripción el accionista o dueño de la empresa). \n - Foto frontal del apoderado o representante legal. \n - Acta Constitutiva y Estatutos Sociales de la empresa y sus modificaciones. \n - Cualquier otro documento que requiera la SUNACRIP. (Bien pudiera interpretarse como facturas de equipos de minería, de computación, identificación del domicilio.) \n \nSeguidamente a este trámite, la SUNACRIP luego de verificar los documentos, y la información requerida, procederá a emitir digitalmente un número o código de RISEC para identificar a la empresa o persona natural que se inscribió, la cual al obtener esta identificación ya le permitirá dentro del territorio venezolano operar y administrar al usuario todo lo relacionado con el mundo de los criptoactivos y sus distintas formas conexas de intercambio, funcionamiento y su comercialización, Blockchain, Trading, Exchange, Billeteras Digitales y evitar así las sanciones establecidas en la Ley del Sistema Integral de Criptoactivos. \n\nEs por ello que es importante que tanto las empresas o personas naturales cumplan con el requisito indispensable y obligatorio de inscripción para obtener su número RISEC con la finalidad que posea y cuente con un medio o mecanismo de defensa al momento de que la SUNACRIP le realice una inspección o fiscalización y de esta forma evitar que le nieguen o le revoquen realizar cualquier actividad bajo este contexto, o en algunos casos sea sancionado, multado o confiscado de forma indebida por la SUNACRIP, ya que estas atribuciones que posee este ente público en relación a las inspecciones y sus posibles sanciones están establecidos en los artículos 34 y 37 de la Ley del Sistema Integral de Criptoactivos, dado que el artículo 34 constituye el procedimiento a seguir (inspección o fiscalización) en caso de un incumplimiento a la Ley y/o a la Providencia, como por ejemplo no contar con la inscripción ante la SUNACRIP y obtener el RISEC y el artículo 37 establece las sanciones que les pueden aplicar a las personas naturales o jurídicas que se les determine una violación a la Ley y/o a la Providencia, los cuales se transcriben a continuación para mejor conocimiento\n\n**Artículo 34.-** “La Superintendencia Nacional de Criptoactivos y Actividades Conexas de Venezuela SUNACRIP, a través de la intendencia competente y haciendo uso de los medios técnicos más idóneos, inspeccionará las actividades propias del sector de criptoactivos, para determinar la verdad de los hechos, que permitan conocer la conformidad o incumplimiento de los deberes establecidos por este decreto Constituyente, los responsable, el grado de que responsabilidad y de ser procedente el daño causado”.\n\nPárrafo Primero.- Podrá apoyarse en organismos públicos competentes cuando se presuma la posible afectación de seguridad, de protección ambiental, de precios y de servicios públicos”. \n\n**Artículo 37.-** “Si durante la inspección o fiscalización, la funcionaria o funcionario actuante detectara indicios de incumplimiento de las obligaciones previstas en este Decreto Constituyente, y existieren elementos que permiten presumir que se puedan causar lesiones graves o de difícil reparación a la colectividad; podrán adoptar y ejecutar en el mismo acto, medidas preventivas destinadas a impedir que se continúen quebrantando las normas que regulan la materia, conforme al ordenamiento jurídico aplicable”.\n\nDichas medidas podrán consistir en:\n- Comiso.\n- Suspensión de Licencias, permisos o autorizaciones emitidas por la Superintendencia Nacional de Criptoactivos y Actividades Conexas (SUNACRIP).\n- Cualquier otra prevista en el ordenamiento jurídico para impedir la vulneración de los derechos de los ciudadanos. \n\nCuando se ordena la medida de comiso sobre los equipos de minería, la Superintendencia custodiará los respectivos bienes, los cuales en caso de quedar firme la medida, podrán ser dispuestos con fines sociales mediante acto motivado, que a tal efecto suscribirá el Superintendente. \n\nEn este sentido y luego de observar lo estipulado en los artículos 34 y 37 de la Ley, donde de forma explícita establece sanciones por el incumplimiento de sus disposiciones, se recomienda que cualquier persona natural o jurídica domiciliada en Venezuela o en el Extranjero, que desee incursionar y/o ya esté incursionando de forma física y presencial dentro de la jurisdicción venezolana en el mundo de la minería digital, sus servicios, funcionamiento, blockchain y cualquier otra forma de comercialización e intercambio de las mismas, puede hacerlo sin ninguna restricción, ni limitación, siempre y cuando las actuaciones se adecuen y cumplan con las disposiciones de la Ley, es decir, deben cumplir el requisito de “inscribirse” ante la Superintendencia Nacional de Criptoactivos (SUNACRIP) para obtener su RISEC. \n\nEs importante señalar además que esta autorización o licencia señalada como RISEC es de forma amplia, es decir, las empresa y personas naturales que la obtengan tienen la ventaja para operar el sector minero virtual “en Venezuela”, “para Venezuela” y “para el Exterior”, en forma amplia y legal, toda vez que la misma Ley dentro de las disposiciones no establece restricciones para el usuario que la adquiera, lo que podría interpretarse que se podrá operar, comercializar e intercambiar bienes, servicios, valores y cualquier forma de minado digital, además podrán ejercer Blockchain, Billeteras Digitales, Compra y Venta de los distintos Criptoactivos, Exchange, Trading y cualquier otra actividad conexa sin ninguna limitación. \n\t\nEn consecuencia y para culminar en base a estos principios es de señalar, que todas aquellas personas tanto naturales como jurídicas que tengan la intención de ejercer y desarrollar la comercialización, intercambio de bienes y servicios, practicar el minado digital y su funcionamiento, Blockchain, Billeteras Digitales, Compra y Venta de los distintos Criptoactivos, Exchange, Trading y cualquier otra actividad conexa y afines que su domicilio sea en Venezuela deberán inscribirse ante la Superintendencia Nacional de Criptoactivos para obtener su licencia RISEC y de esta forma quedarán autorizadas para operar ese amplio sector desde y para el territorio nacional e inclusive para el extranjero; e igualmente las personas jurídicas con domicilio fuera del territorio nacional (extranjeras) que tengan o vayan a tener algún tipo de dispositivos electrónicos, de computación, o de minería digital y algún personal y/o representante que quieran operar y dar sus servicios dentro del territorio venezolano sobre cualquier actividad relacionado con la compra y venta de Criptoactivos y sus distintas actividades de comercialización, funcionamiento e intercambio de bienes, valores y servicios, Blockchain, Billeteras Digitales, Exchange, Trading y cualquier otra actividad conexa y afines, deberán acudir ante la SUNACRIP a notificar su intención y propósito, dado que en caso contrario de no realizar la inscripción, podrán ser objetos de las sanciones establecidas en la norma. \n\nPuedes descargar el informe completo en el siguiente link:\n[Descarga - Informe De Obligaciones Establecidas en el Marco Legal Venezolano para Comercios Blockchain](https://www.dropbox.com/s/1nfw6tre57qswuj/PDF-DocumentoObligaciones.pdf?dl=0)",

Es importante señalar y aclarar en concordancia con el párrafo anterior, que la Ley y su Providencia abarcan en su contenido en principio a las empresas y personas naturales que tengan su domicilio fiscal en la República Bolivariana de Venezuela; sin embargo en el caso de las empresas o personas jurídicas extranjeras que su domicilio sea fuera de Venezuela y quieran ejercer actividades de servicios, funcionamiento, emisión, intercambio de criptoactivos, blockchain, trading, minería digital y sus distintas actividades afines, también son objeto de la aplicación de la norma siempre y cuando su actividad y operatividad vaya ser ejercida de forma presencial dentro de la jurisdicción o del territorio venezolano y que simultáneamente concurran una presencia física y tangible tanto de personas, trabajadores o representantes de las empresas extranjeras, así como presencia física y tangible de objetos y equipos de minería o dispositivos de computación o electrónicos; ya que en el caso de que están empresas extranjeras no vayan a tener presencia ni de personal, ni de equipos electrónicos en Venezuela no están bajo la obligatoriedad de las disposiciones de la Ley y su Providencia, toda vez que estas dos (2) disposiciones legales no gozan de “extraterritorialidad”, debido a que es una norma creada y promulgada solo para ejercer su autoridad dentro del territorio venezolano. Establecido lo anterior y al existir un marco jurídico ya promulgado en Venezuela, es de analizar conforme al derecho que estas dos (2) normativas son de obligatorio cumplimiento dentro de la jurisdicción venezolana y es de resaltar que el primer paso para que las personas naturales y jurídicas y que sean extranjeras o no que deseen realizar actividades como intercambio de bienes, servicios, valores, funcionamiento, intercambio de criptoactivos, blockchain, trading, minería digital y sus distintas actividades conexas, dentro del territorio venezolano, deben cumplir con el primer requisito que es la “inscripción” para obtener el RISEC, que es la autorización o licencia que otorga el Estado Venezolano a través de la Ley a las personas naturales y jurídicas para que practiquen de forma legal las distintas actividades de minerías digital y sus diferentes formas de servicios, funcionabilidad, intercambio y comercialización. Al conocer lo anterior, el artículo 30 de la Ley del Sistema Integral de Criptoactivos, define la obligatoriedad de la “inscripción” para las personas naturales y jurídicas que pretendan desarrollar y/o ya estén desarrollando bajo suelo venezolano cualquier actividad comercial con criptoactivos y sus distintas actividades de intercambio y comercialización que sean afines y será a través de un registro de información, que se administrará a través de la Superintendencia Nacional de Criptoactivos (SUNACRIP) y tendrá su desde principal en la Ciudad de Caracas, quién la inspeccionará y supervisará, toda vez que la SUNACRIP (por sus siglas en castellano) es el ente público creado por la Ley para supervisar y regular todo lo referente al sector minero virtual de criptoactivos y sus demás actividades de servicios, intercambio, valores, emisión y funcionamiento. Ahora bien, los pasos a seguir para que las personas naturales o empresas domiciliadas en Venezuela o las extranjeras que tengan algún tipo de interés de tener presencia de personal o de cualquier equipo electrónico, de computación o de minería y que tengan la intención de realizar algún tipo de comercialización, intercambio de servicios de criptoactivos y su funcionamiento, blockchain, trading, minería digital y sus distintas actividades conexas y afines dentro del territorio nacional, deben cumplir de forma obligatoria con lo establecido en el mencionado artículo 30 de la Ley del Sistema Integral de Criptoactivos para obtener el RISEC a través de la inscripción, procedimiento este que está establecido en los artículo 8 y 9 de la “Providencia mediante la cual regula el Registro Integral de Servicios de Criptoactivos”, la cual en los artículos antes señalados están constituidos los pasos que se debe cumplir para obtener la autorización, junto con una serie de requisitos, los cuales se detallan a continuación: **Artículo 8.-** Ingresar al portal web [www.sunacrip.gob.ve](www.sunacrip.gob.ve) para registrarse y poder acceder a la plataforma RISEC, luego completar y aceptar el cuestionario solicitado; los cuales son identificación y domicilio de las personas naturales o jurídicas, identificación de sus representantes, suscripción digital de la Declaración Jurada de que los fondos destinados provienen de actividades licitas, así como los demás documentos que se requieran en el artículo 9 deben ser cargados digitalmente, los cuales son: **Artículo 9.-** *Persona Natural:* - Cédula de identidad o Pasaporte vigente. - Foto Frontal - Cualquier otro documento solicitado por la SUNACRIP. (Bien pudiera interpretarse como facturas de equipos de minería, de computación, identificación del domicilio.) *Persona Jurídica:* - Registro de Información Fiscal de la empresa (RIF). - Documento autenticado o registrado para constar la representación legal o apoderado (en caso que no haga la inscripción el accionista o dueño de la empresa). - Foto frontal del apoderado o representante legal. - Acta Constitutiva y Estatutos Sociales de la empresa y sus modificaciones. - Cualquier otro documento que requiera la SUNACRIP. (Bien pudiera interpretarse como facturas de equipos de minería, de computación, identificación del domicilio.) Seguidamente a este trámite, la SUNACRIP luego de verificar los documentos, y la información requerida, procederá a emitir digitalmente un número o código de RISEC para identificar a la empresa o persona natural que se inscribió, la cual al obtener esta identificación ya le permitirá dentro del territorio venezolano operar y administrar al usuario todo lo relacionado con el mundo de los criptoactivos y sus distintas formas conexas de intercambio, funcionamiento y su comercialización, Blockchain, Trading, Exchange, Billeteras Digitales y evitar así las sanciones establecidas en la Ley del Sistema Integral de Criptoactivos. Es por ello que es importante que tanto las empresas o personas naturales cumplan con el requisito indispensable y obligatorio de inscripción para obtener su número RISEC con la finalidad que posea y cuente con un medio o mecanismo de defensa al momento de que la SUNACRIP le realice una inspección o fiscalización y de esta forma evitar que le nieguen o le revoquen realizar cualquier actividad bajo este contexto, o en algunos casos sea sancionado, multado o confiscado de forma indebida por la SUNACRIP, ya que estas atribuciones que posee este ente público en relación a las inspecciones y sus posibles sanciones están establecidos en los artículos 34 y 37 de la Ley del Sistema Integral de Criptoactivos, dado que el artículo 34 constituye el procedimiento a seguir (inspección o fiscalización) en caso de un incumplimiento a la Ley y/o a la Providencia, como por ejemplo no contar con la inscripción ante la SUNACRIP y obtener el RISEC y el artículo 37 establece las sanciones que les pueden aplicar a las personas naturales o jurídicas que se les determine una violación a la Ley y/o a la Providencia, los cuales se transcriben a continuación para mejor conocimiento **Artículo 34.-** “La Superintendencia Nacional de Criptoactivos y Actividades Conexas de Venezuela SUNACRIP, a través de la intendencia competente y haciendo uso de los medios técnicos más idóneos, inspeccionará las actividades propias del sector de criptoactivos, para determinar la verdad de los hechos, que permitan conocer la conformidad o incumplimiento de los deberes establecidos por este decreto Constituyente, los responsable, el grado de que responsabilidad y de ser procedente el daño causado”. Párrafo Primero.- Podrá apoyarse en organismos públicos competentes cuando se presuma la posible afectación de seguridad, de protección ambiental, de precios y de servicios públicos”. **Artículo 37.-** “Si durante la inspección o fiscalización, la funcionaria o funcionario actuante detectara indicios de incumplimiento de las obligaciones previstas en este Decreto Constituyente, y existieren elementos que permiten presumir que se puedan causar lesiones graves o de difícil reparación a la colectividad; podrán adoptar y ejecutar en el mismo acto, medidas preventivas destinadas a impedir que se continúen quebrantando las normas que regulan la materia, conforme al ordenamiento jurídico aplicable”. Dichas medidas podrán consistir en: - Comiso. - Suspensión de Licencias, permisos o autorizaciones emitidas por la Superintendencia Nacional de Criptoactivos y Actividades Conexas (SUNACRIP). - Cualquier otra prevista en el ordenamiento jurídico para impedir la vulneración de los derechos de los ciudadanos. Cuando se ordena la medida de comiso sobre los equipos de minería, la Superintendencia custodiará los respectivos bienes, los cuales en caso de quedar firme la medida, podrán ser dispuestos con fines sociales mediante acto motivado, que a tal efecto suscribirá el Superintendente. En este sentido y luego de observar lo estipulado en los artículos 34 y 37 de la Ley, donde de forma explícita establece sanciones por el incumplimiento de sus disposiciones, se recomienda que cualquier persona natural o jurídica domiciliada en Venezuela o en el Extranjero, que desee incursionar y/o ya esté incursionando de forma física y presencial dentro de la jurisdicción venezolana en el mundo de la minería digital, sus servicios, funcionamiento, blockchain y cualquier otra forma de comercialización e intercambio de las mismas, puede hacerlo sin ninguna restricción, ni limitación, siempre y cuando las actuaciones se adecuen y cumplan con las disposiciones de la Ley, es decir, deben cumplir el requisito de “inscribirse” ante la Superintendencia Nacional de Criptoactivos (SUNACRIP) para obtener su RISEC. Es importante señalar además que esta autorización o licencia señalada como RISEC es de forma amplia, es decir, las empresa y personas naturales que la obtengan tienen la ventaja para operar el sector minero virtual “en Venezuela”, “para Venezuela” y “para el Exterior”, en forma amplia y legal, toda vez que la misma Ley dentro de las disposiciones no establece restricciones para el usuario que la adquiera, lo que podría interpretarse que se podrá operar, comercializar e intercambiar bienes, servicios, valores y cualquier forma de minado digital, además podrán ejercer Blockchain, Billeteras Digitales, Compra y Venta de los distintos Criptoactivos, Exchange, Trading y cualquier otra actividad conexa sin ninguna limitación. En consecuencia y para culminar en base a estos principios es de señalar, que todas aquellas personas tanto naturales como jurídicas que tengan la intención de ejercer y desarrollar la comercialización, intercambio de bienes y servicios, practicar el minado digital y su funcionamiento, Blockchain, Billeteras Digitales, Compra y Venta de los distintos Criptoactivos, Exchange, Trading y cualquier otra actividad conexa y afines que su domicilio sea en Venezuela deberán inscribirse ante la Superintendencia Nacional de Criptoactivos para obtener su licencia RISEC y de esta forma quedarán autorizadas para operar ese amplio sector desde y para el territorio nacional e inclusive para el extranjero; e igualmente las personas jurídicas con domicilio fuera del territorio nacional (extranjeras) que tengan o vayan a tener algún tipo de dispositivos electrónicos, de computación, o de minería digital y algún personal y/o representante que quieran operar y dar sus servicios dentro del territorio venezolano sobre cualquier actividad relacionado con la compra y venta de Criptoactivos y sus distintas actividades de comercialización, funcionamiento e intercambio de bienes, valores y servicios, Blockchain, Billeteras Digitales, Exchange, Trading y cualquier otra actividad conexa y afines, deberán acudir ante la SUNACRIP a notificar su intención y propósito, dado que en caso contrario de no realizar la inscripción, podrán ser objetos de las sanciones establecidas en la norma. "body": "## <center>“OBLIGACIONES ESTABLECIDAS EN EL MARCO LEGAL VENEZOLANO PARA LAS EMPRESAS NACIONALES Y EXTRANJERAS QUE DESEEN EJERCER ACTIVIDADES COMERCIALES DE MINERIA DIGITAL, BLOCKCHAIN, TRADING Y SUS OTRAS ACTIVIDADES AFINES Y CONEXAS\"</center>\n\n\n\nCon la entrada en vigencia de la *“Ley del Sistema Integral de Criptoactivos”* en fecha 30 de enero de 2019 y la posterior promulgación de otra norma denominada “*Providencia mediante la cual se regula el Registro Integral de Servicios de Criptoactivos*” en fecha 04 de febrero de 2019, en Venezuela ya se cuenta con una serie de bases legales que regirán y regularán de forma general las múltiples actividades de servicios, operatividad y sus diferentes relaciones comerciales de las empresas y personas naturales, que tengan como actividad el intercambio y funcionamiento de criptoactivos, blockchain, trading, minería digital y sus distintas actividades conexas y afines, dado que estas normativas permiten y le dan carácter de legitimidad y legalidad a todas estas múltiples actividades antes mencionadas y que tengan alguna forma de representación y comercialización dentro del territorio venezolano. \n \nEs importante señalar y aclarar en concordancia con el párrafo anterior, que la Ley y su Providencia abarcan en su contenido en principio a las empresas y personas naturales que tengan su domicilio fiscal en la República Bolivariana de Venezuela;
